Spanish NIF for EPR: who needs one and the notarised power of attorney

Summary

Spain packaging can only be filed once a Spanish NIF has been issued. Without one, Eldris prepares the NIF power of attorney and you have it notarised and apostilled at home; a NIF you already hold means no NIF charge.

Yes, if you register packaging in Spain and hold no Spanish tax number. The Spanish NIF for EPR must be issued before a packaging registration can be filed. Without one, Eldris prepares the NIF power of attorney from your details and sends it with instructions. You have it notarised and apostilled in your home country. With a NIF already, there is no NIF charge. Packaging takes far longer without one, as the pricing page shows. Under Regulation (EU) 2025/40 (the PPWR), Article 44(4), packaging may not be made available in Spain until that registration exists.

Who needs a Spanish NIF for EPR, and what counts as one

A seller that registers packaging in Spain needs a Spanish NIF: the tax identification number for non-resident companies. The Spanish packaging producer register does not accept a foreign VAT number in its place. A Spanish NIF or Spanish VAT number you already hold is enough, and no new NIF is then obtained.

The requirement comes from the register, not from Eldris. Spain keeps its producer register at MITECO, the Ministry for the Ecological Transition, and its packaging part takes no filing without a Spanish NIF. The duty to register is EU law. Under Regulation (EU) 2025/40, Article 44(2), a producer registers in each member state where it first makes packaging available, and Article 44(4) forbids doing so before it is registered. A seller established outside Spain that sells to end users there also appoints a packaging representative under Article 45(3). Eldris makes that appointment under your power of attorney, as the Spain page sets out. In your portal, the Spain section asks whether you already hold a Spanish NIF and, if you do, which one. Answer yes and give the number, and Eldris files with it. Answer no, and Eldris obtains one for you. That route needs an apostilled power of attorney and adds lead time, so look through your company's records before you answer.

What the NIF power of attorney involves

Eldris prepares the NIF power of attorney from the details you have already given. It sends the document to you with instructions once your file is reviewed, and you have it notarised and then apostilled in your home country. There is nothing to find or upload for it in advance.

It is a separate document from your standard Spanish power of attorney. The standard one appoints the representative and covers the registrations. It is drawn up in two languages, one of them Spanish, and signed online. The NIF power of attorney is the one for the NIF application itself. Sign it exactly as your name appears in your passport: the passport, the company certificate and every signature must show one name. The NIF application also needs a sworn Spanish translation of your incorporation document. Eldris gives you the contact of a sworn translator, and you pay the translator directly. Spain is the hardest market on the Eldris list for paperwork. Its documents are translated and notarised by a verified body. The notary and the apostille happen in your home country, so book them, and the translation, when the instructions arrive. The other documents are in the documents guide.

Which Spanish registrations wait for the NIF

Spain packaging waits: it can only be filed once your Spanish NIF has been issued. The NIF is asked for, and quoted, only with Spain packaging; electrical equipment and batteries have their own Spanish registers. If the order of the Spanish files matters to you, say so before you pay.

The dependency is built into the price list. When a quote includes Spain packaging and you hold no Spanish NIF or Spanish VAT number, the calculator adds the NIF as a one-off line. Each stream then has its own register and its own legal duty. Electrical equipment is registered under Directive 2012/19/EU, Article 16(1), and batteries under Regulation (EU) 2023/1542, Article 55(2). Packaging follows the PPWR article above. In each case registration comes before the products are placed on the Spanish market. A NIF that is still pending is therefore not a reason to start selling. Once the NIF is issued, Eldris files the packaging registration, and the authority and the scheme set the pace from submission. If you sell more than one stream in Spain and the order matters, list them in your reply to the quote before you pay.

What the NIF step costs, and what is not an Eldris fee

The NIF is a one-off line on the Eldris price list, shown against Spain on the pricing page. It is added only when you hold no Spanish NIF or Spanish VAT number. The notary and apostille step happens in your home country, and any cost of it is not an Eldris fee.

The line is charged once. Each Spanish registration runs for 12 months from the date Spain confirms it, and the one-off NIF line is not charged again with it. Under the Terms, section 6.1, one-off items such as a Spanish NIF are non-refundable once the registration work has begun. The NIF line also lists a government fee for the number, passed through at cost, as its entry on the pricing page shows. Any notary or apostille cost depends on your local notary, and the sworn translator's fee is paid directly to the translator. The packaging registration that the NIF unlocks has third-party charges of its own. They are a one-off authority registration fee, a yearly minimum disposal charge and per-kilogram charges above the line's allowance. Those are passed through at cost and never marked up. The figures the scheme and the authority publish are in the Spanish scheme fees section of the Spain page.

How long the NIF adds, and what holds the step up

The pricing page shows two averages for Spain packaging: with a NIF or Spanish VAT number, and far longer without. Obtaining a NIF adds lead time, and the NIF must be issued before the packaging file goes in. Averages come from recent registrations and are not guarantees, so Eldris promises no date.

The average counts from the day Eldris has your complete documents and signed power of attorney. Several gaps can hold up the NIF step, and each is avoidable. The name on a signature differs from the passport or the company certificate. The notary appointment is not yet booked, or the apostille is still pending. The sworn translation of the incorporation document has not been ordered. A foreign VAT number is entered where the portal asks for a Spanish NIF. A Spanish NIF you already hold is not declared, so the quote carries a NIF line you do not need. The portal also asks for any Spanish register numbers you hold for packaging, electrical equipment or batteries. That prevents a duplicate inscription. If a marketplace has given you a deadline for Spain, say so before you pay, by replying to your quote. The Spain checklist on fees, logos and labels covers the wider picture. The short answer sits on the questions page.

Frequently asked questions

Is my EU VAT number enough instead of a Spanish NIF?

No, unless it is a Spanish VAT number. The Spanish packaging register does not accept a foreign VAT number in place of a NIF. A Spanish NIF or Spanish VAT number you already hold is enough, and the quote then carries no NIF line.

Do I have to travel to Spain to see a notary?

No. The NIF power of attorney is notarised and apostilled in your home country, by a notary there. Eldris prepares the document from your details and sends it to you with instructions once your file is reviewed.

Can my WEEE and battery registrations start before the NIF is issued?

Say so before you pay if the order matters. Spain packaging cannot be filed until the NIF has been issued, and the NIF is asked for and quoted only with Spain packaging. Electrical equipment and batteries have their own Spanish registers. None of the three is sold before its own registration.

Is the NIF charged again in later years?

No. The NIF is a one-off line: it is charged once and is not charged again with the registration lines. Under the Terms, section 6.1, one-off items such as a Spanish NIF are non-refundable once the registration work has begun.

Are the notary, the apostille and the translation Eldris fees?

No. The notary and apostille step happens in your home country, and any cost of it is not an Eldris fee. Eldris provides the contact of a sworn translator for the Spanish translation of your incorporation document, and the translator's fee is paid directly.

I already hold a Spanish NIF. What should I do?

Tell Eldris before you pay, by replying to your quote, and give the number where the portal's Spain section asks for it. There is then no NIF charge. Add any Spanish register numbers you already hold, so that no duplicate inscription is made.
